1. Estimate Disclaimer
This is an Estimate Only.
1.1 All pricing provided is indicative and subject to change.
1.2 Final costs may vary depending on a range of factors including (but not limited to) site conditions, property access, the presence of rock or other unforeseen excavation challenges, changes in material costs, and supplier availability.
1.3 A site inspection will be required to confirm the scope of works.
1.4 Any variations or additional charges will be discussed and agreed upon prior to commencement or continuation of work.
2. Deposit & Payments
2.1 To secure your booking with KAMCO Arenas, a deposit is required.
2.2 No work will be scheduled or commenced until the deposit has been received in full.
2.3 KAMCO Arenas may issue interim invoices at its discretion based on progress, product supply, or other agreed stages of the project.
2.4 If an interim payment is requested, all works will cease until payment is received in full. Delays resulting from late payment are the sole responsibility of the client.
2.5 Final payment may be due prior to full completion of the arena. KAMCO Arenas reserves the right to withhold delivery of final works until full payment has been made.
2.6 Failure to comply with payment terms may result in additional charges, recovery action, or termination of the agreement without liability to KAMCO Arenas.
3. Rock Removal & Site Conditions
3.1 This estimate excludes sub-soil drainage, rock breaking, or rock removal unless expressly stated in writing.
3.2 If rock, debris, groundwater, or other unexpected conditions are encountered during excavation, additional charges will apply.
3.3 These charges will be assessed on-site and communicated to the client before any further work proceeds.
4. Product Variation
4.1 Due to the nature of raw materials used in equestrian arena construction (e.g. river sand, woodchip, metal dust), natural variation in texture, colour, particle size, and consistency may occur.
4.2 While KAMCO Arenas cannot guarantee material uniformity, all materials are subject to quality control and will not be used if they fall below acceptable performance standards.
5. Site Access
5.1 The client must ensure clear, safe, and unobstructed access for trucks, delivery vehicles, and heavy machinery at all times during the construction process.
5.2 Any delays, additional labour, or machinery costs due to limited or unsafe access will be the responsibility of the client.
6. Indemnity
6.1 By engaging KAMCO Arenas, you confirm that you have made all reasonable enquiries to identify the location of any electrical, telecommunications, water, sewerage, and gas services (the ‘Services’), and that you have provided accurate and complete instructions to KAMCO regarding their locations.
6.2 You hereby agree to indemnify and keep KAMCO indemnified against any actions, suits, proceedings, claims, or demands arising in connection with any Services located on your site.
6.3 You are not required to indemnify KAMCO under this clause if a claim arises due to KAMCO intentionally commencing works in an area of your site that you have instructed contains the Services.
6.4 The indemnity provided by you is a continuing obligation, independent of other obligations under this Agreement, and it survives the termination of this Agreement.
6.5 KAMCO is not required to incur any expense or make any payment before enforcing its right to indemnity under this Agreement.
6.6 You agree to pay KAMCO on demand any amount due under this indemnity.
7. Arena Maintenance
7.1 To preserve the integrity, performance, and longevity of your arena, regular maintenance is essential.
7.2 This includes routine grooming, levelling, and watering where possible, and avoiding activities that cause excessive wear (e.g. lunging).
7.3 Failure to maintain the surface may result in accelerated degradation and is outside the responsibility of KAMCO Arenas.
8. Limitation of Liability
8.1 KAMCO Arenas shall not be liable for any indirect, incidental, special, or consequential loss or damage whatsoever, including (but not limited to) loss of use, financial loss, delay costs, loss of business, loss of enjoyment, or disruption to events or schedules.
8.2 The client acknowledges and accepts full responsibility for any plans, bookings, or commitments (including events or competitions) made in reliance on estimated timelines.
8.3 KAMCO Arenas makes no guarantees regarding project completion dates, and shall not be held responsible for any loss or inconvenience caused by delays.
8.4 To the maximum extent permitted by law, KAMCO Arenas’ total liability for any claim arising from or in connection with the services provided shall be limited to the total amount actually paid by the client for those services.
9. Force Majeure
9.1 KAMCO Arenas shall not be liable for any failure or delay in the performance of its obligations where such failure or delay is due to circumstances beyond its reasonable control, including but not limited to: extreme weather conditions, acts of God, equipment breakdown, pandemics, supply chain disruption, labour shortages, transport delays, government restrictions, or civil unrest.
9.2 In the event of such delays, the client accepts that work may be rescheduled without penalty or compensation.
9.3 The client agrees not to schedule events or make critical commitments reliant on estimated completion dates without first seeking written confirmation from KAMCO Arenas.
9.4 KAMCO Arenas will take reasonable steps to resume or complete works as soon as reasonably practicable and will communicate revised timeframes if necessary.
10. Acceptance of Terms
10.1 By accepting this estimate and proceeding with the engagement of KAMCO Arenas, the client acknowledges that they have read, understood, and agreed to these Terms & Conditions in full.
10.2 These Terms & Conditions shall apply to all services provided unless otherwise agreed in writing.
